Nasruddin assassin gets 18 years in prison

The Tangerang District Court on Wednesday sentenced Daniel Daen Sabon to 18 years in prison for killing businessman Nasruddin Zulkarnaen in a drive-by shooting in Tangerang.
The district court chief  M. Asnun, who presided over the trial, said based on the facts and testimonies disclosed during the trial, Daniel was proven guilty of killing Nasruddin.

“The defendant had also confessed to having shot the victim in the head twice from close range and was aware the shots would be fatal,” Asnun said.

Asnun said the panel of judges felt the defense filed by the defendant’s lawyers was unreasonable.

The panel said the fact that Daniel had given confusing testimony, that he received Rp 30 million of
the Rp 75 million (US$7,875) promised for the murder, that he denied killing the victim, and that he had been imprisoned once before were factors leading to the issuing of a severe sentence.

“The sentence would have been harsher but for the fact that the defendant is still young and was polite during the trial,” Asnun said.

In other related trials, four suspects in the same murder case — Henrikus Kia Walen, Heri Santosa, Fransiskus Tadin Keran and Eduardus Ndopo Mbete — were each sentenced to 17 years in prison. 

Arthur Hangewa, presiding over Eduardus’ trial, and Ismail, presiding over the trial of Heri, Henrikus, Fransiskus also cited similar factors leading to the verdict.  

In response to the verdict, both prosecutors and the defense lawyers said they would appeal the decision with the Banten High Court.

Rocky Awondatu, Daniel’s lawyer said the panel of judges admitted the defendants were victims of psychological manipulation by the masterminds plotting the murder.

They were told to murder to save the state, he said.

“This means they receive a lighter sentence,” he said.

Nasruddin, the former director of state-owned pharmaceutical company PT Putra Rajawali Banjaran, was killed on March 14 in a drive-by shooting near Modern Land Golf Course in Tangerang.

Prosecutors headed by Rahmat Haryanto, the head of special crimes at the Tangerang Prosecutor’s Office, had charged all five on counts of premeditated murder.

Prosecutors had sought life imprisonment for the five, even though premeditated murder carries the death penalty.

Prosecutors said former Corruption Eradication Commission (KPK) chairman Antasari Azhar, former South Jakarta Police chief Sr. Comr. Wiliardi Wizard and media mogul

Sigid Haryo Wibisono had offered to pay Eduardus to kill someone they claimed posed a threat to the state in the run up to general elections, during a meeting at the Hailai club in Ancol, North Jakarta, in January.

Following the meeting, Eduardus, who was promised Rp 500 million for the murder, recruited Henrikus, who in turn recruited Daniel, Heri and Fransiskus.

Prosecutors said that on March 14, Daniel, who was watching Nasruddin’s house, saw the victim leave in his BMW sedan and followed him to Modern Land Golf Course.

He then informed Henrikus, who later followed Nasruddin in an Avanza minivan driven by Sei Lela, who remains at large.

When the car slowed down on Jl. Hartono Raya, the suspects overtook and blocked it. Daniel, riding pillion on one of the motorbikes, pulled out a gun and shot Nasruddin.

Antasari, Wiliardi and Sigid Haryo Wibisono are being tried at the South Jakarta District Court.
